Terms of Service

Welcome to PMMilestone.com — the Global Encyclopedia of Project Management & Project Controls, and the official knowledge hub of PMMilestone.org. These Terms of Service (the "Terms") govern your access to and use of the website at the domain pmmilestone.com, including the A–Z encyclopedia, career guides, articles, downloadable resources, embedded calculators, and any related sub-pages or services we make available from time to time (together, the "Service"). By accessing or using the Service in any way — including reading, linking to, citing, downloading, embedding or otherwise using its content — you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

1. Who we are

PMMilestone.com is operated by Dr. Hassan Eliwa, PhD ("we", "us", "our"), trading through Eliwa.co.nz and PMMilestone.org, with editorial responsibility resting with the named founder. The relationship between PMMilestone.com (this site) and PMMilestone.org (the flagship operational platform with the Project Controls Academy, calculators, glossary, learning tracks and books library) is described on the About page.

2. Acceptance and changes to these Terms

By using the Service you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction), that you have the legal capacity to enter into a binding agreement, and that, if you are using the Service on behalf of a company, partnership, public authority or other entity, you have the authority to bind that entity to these Terms. We may update these Terms from time to time to reflect changes in law, in our services, or in editorial policy. Updates are effective from the date posted at the top of this page. Continued use of the Service after a change indicates acceptance of the updated Terms. Material changes — for example, the addition of a paid feature or a substantive change to the licence we grant you — will be highlighted on this page or in a notice on the home page.

3. The Service — what we provide

PMMilestone.com provides free-to-read editorial content in the field of project management and project controls. This includes, but is not limited to, the A–Z encyclopedia, the career guides, articles, charts and tables, downloadable templates referenced via the flagship platform, and FAQ blocks attached to each page. We may add, change, suspend or remove any part of the Service at any time, with or without notice. We do not undertake to keep any specific page, URL, image or chart available indefinitely. Where a URL is retired, we attempt to issue a permanent (HTTP 301) redirect to the most appropriate replacement; we make no warranty that any specific redirect will be maintained.

4. Intellectual property and content licence

All text, images, charts, tables, diagrams, logos, JSON-LD metadata, source code, design elements and other materials on PMMilestone.com (the "Content") are owned by, or licensed to, Dr. Hassan Eliwa, PhD and protected by international copyright, trademark, database-right and related laws. The marks "PMMilestone", "PMMilestone.com", "PMMilestone.org" and associated logos are trademarks owned by the founder.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access the Content for your personal, non-commercial reading and reference, and to cite or quote short excerpts (typically less than 200 words from any single page, and a smaller proportion of any chart or table) in academic, professional or editorial work — provided that you (a) attribute the quotation clearly to PMMilestone.com and the named author, (b) include a stable canonical link to the source page, and (c) do not present the quotation in a manner that misleads readers as to its origin, purpose or licensing.

Except as expressly permitted above, you may not reproduce, redistribute, syndicate, republish, scrape, mirror, modify, translate, sell, sub-license or otherwise exploit any Content without our prior written consent. AI training, large-scale text-and-data mining and automated republication are not permitted without an express written licence; we reserve all rights under applicable text-and-data mining opt-outs (including those provided for under New Zealand, EU and UK law). Embedding our charts or tables in commercial training material requires a written licence from hassan.eliwa@eliwa.co.nz.

5. User contributions

If you submit a correction, contribution, comment, case study, manuscript or any other material to PMMilestone.com (a "Submission"), you represent and warrant that (a) the Submission is your own original work, or you have the rights to submit it, (b) it does not infringe any third party's intellectual property, privacy, confidentiality or moral rights, (c) it complies with applicable law, and (d) it does not contain defamatory, unlawful or misleading material. You grant Dr. Hassan Eliwa, PhD a worldwide, perpetual, irrevocable, royalty-free, sub-licensable licence to use, edit, adapt, publish, store and redistribute the Submission in any current or future medium, with or without attribution, in connection with PMMilestone.com, PMMilestone.org and related publications. You waive any moral rights you may have in the Submission to the extent permitted by law. We have no obligation to publish any Submission, and we may edit Submissions for clarity, length, accuracy and house style.

6. Acceptable use

When using the Service, you agree that you will not, and you will not permit any third party to:

  • Use the Service for any unlawful, harmful, fraudulent, defamatory or abusive purpose;
  • Misrepresent your affiliation with the Service, the founder, or any third party;
  • Attempt to gain unauthorised access to any part of the Service, any related infrastructure, accounts, servers, or data;
  • Interfere with or disrupt the integrity or performance of the Service, including by introducing viruses, worms, ransomware, denial-of-service traffic, or other malicious code;
  • Use automated means — bots, crawlers, scrapers, headless browsers — to access the Service at a rate, frequency or volume that materially exceeds normal human browsing, except for compliant search engine crawlers governed by the published robots.txt and sitemap.xml;
  • Reverse-engineer, decompile or otherwise attempt to derive the source code of any part of the Service;
  • Use the Content to train, fine-tune or evaluate any machine-learning model — including but not limited to large language models — without an express written licence;
  • Republish, syndicate or mirror the Content on another website, application or AI assistant without the express written consent of the founder;
  • Use any Content in a manner that would mislead a reader into believing that we endorse a product, service, employer, candidate, tender, certification, software vendor or political position that we have not in fact endorsed;
  • Remove, obscure or alter copyright, trademark, author attribution, or canonical-URL metadata.

7. Professional and editorial disclaimer

The Content is general information. It is not, and should not be relied on as, a substitute for professional engineering, legal, contractual, financial, regulatory or risk advice. Every project, every contract, every claim and every regulatory regime is different. Project decisions — including but not limited to schedule baselines, EVM thresholds, contingency drawdown, recovery plans, claim entitlement, change orders, forensic analyses and stage-gate decisions — must be made by qualified professionals familiar with your project, your contract and your jurisdiction. By using the Service you accept that you have read and accepted that Disclaimer, and that no client, advisory, fiduciary, employment or consulting relationship is created between you and the founder by your use of the Service.

8. Third-party content and links

The Service contains links to third-party websites and resources, including the flagship platform PMMilestone.org, social profiles (LinkedIn, X, Medium), publishers (Amazon), academic profiles (Google Scholar, ResearchGate, ORCID), software vendors, standards bodies and consulting partners. These links are provided for your convenience and reference. We do not control these third-party properties, and we accept no responsibility for their availability, accuracy, security practices, terms of use or content. A link is not an endorsement and is not a guarantee. You access third-party properties at your own risk and under their own terms.

9. Advertising

The Service may display advertising, including but not limited to Google AdSense. Advertising is clearly delineated from editorial content. Advertisers are not given access to editorial decisions, rankings or page selection. Where an advertisement, sponsored placement or affiliate link is included, we will mark it appropriately. We follow Google's publisher policies and AdSense programme policies. If you believe an advertisement on the Service breaches those policies, please email hassan.eliwa@eliwa.co.nz with the page URL, a screenshot if possible, and the advertiser, and we will investigate.

10. Privacy and cookies

Our processing of personal information is governed by the Privacy Policy, which forms part of these Terms. By using the Service you confirm that you have read and accepted that Privacy Policy. We use cookies and similar technologies for analytics, security, accessibility preferences, advertising and basic functionality. You can manage cookie behaviour through your browser settings and through any in-product consent controls we surface.

11. Availability, suspension and termination

We aim to keep the Service available continuously, but we do not warrant uninterrupted, error-free or secure access. We may suspend access for maintenance, security, legal or commercial reasons. We may terminate or restrict your access to the Service at any time, without notice, if we reasonably believe you have breached these Terms, used the Service in a manner that exposes us to legal risk, or otherwise acted unlawfully. Termination does not relieve you of obligations accrued before termination, including in respect of intellectual property, confidentiality and indemnity.

12. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the Service and the Content are provided "as is" and "as available", with all faults, without any warranty of any kind, whether express, implied, statutory or otherwise — including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, quiet enjoyment or system integration. We do not warrant that the Service will meet your requirements, that it will be free from errors or omissions, that any defect will be corrected, or that the Service or its underlying infrastructure is free from viruses or other harmful components.

To the maximum extent permitted by law, in no event shall Dr. Hassan Eliwa, PhD, his agents, contributors, licensors or affiliates be liable for any indirect, incidental, special, consequential, exemplary or punitive damages — including but not limited to loss of profit, loss of revenue, loss of business opportunity, loss of goodwill, loss of data, schedule delay, contractual penalties, regulatory fines, professional liability claims, or any costs of substitute goods or services — arising out of or in connection with your access to or use of the Service or the Content, even if we have been advised of the possibility of such damages. Our aggregate liability to you for all claims arising out of or relating to the Service shall not exceed one hundred New Zealand dollars (NZD 100). Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under applicable consumer protection legislation.

13. Indemnity

You agree to defend, indemnify and hold harmless Dr. Hassan Eliwa, PhD, his agents and contributors from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to (a) your use or misuse of the Service or the Content, (b) your breach of these Terms, (c) any Submission you provide, or (d) your violation of any law or the rights of any third party.

14. Governing law and jurisdiction

These Terms are governed by the laws of New Zealand, without regard to its conflict-of-laws principles. You and we submit to the exclusive jurisdiction of the courts of New Zealand for the resolution of any dispute arising out of or in connection with these Terms or the Service. If you access the Service from outside New Zealand, you do so on your own initiative and are responsible for compliance with local laws.

15. Miscellaneous

If any provision of these Terms is held to be unlawful, void or unenforceable, that provision shall be severed and the remainder of the Terms shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. These Terms, together with the Privacy Policy and the Disclaimer, constitute the entire agreement between you and us regarding the Service and supersede any prior agreement on the same subject matter. We may assign these Terms in connection with a merger, acquisition or sale of the Service or its assets; you may not assign these Terms without our written consent.
