Defending a $96M Delay Claim on an Urban Rail Extension

A windows-based forensic schedule analysis defeated a delay claim and recovered prolongation cost.

The contractor on an urban rail extension submitted a $96M delay claim alleging owner-caused delay across three windows. The owner commissioned an independent retrospective windows analysis under AACE RP 29R-03.

Findings

Concurrent contractor delay accounted for 71% of the alleged critical-path slippage. Contractor as-built productivity in segment 4 fell short of as-planned by 38% — a contractor-controlled risk under the contract.

Outcome

The claim was reduced to $7.3M of legitimate owner-caused entitlement. Prolongation cost recovery from the contractor offset $4.1M of the remaining award.
